AGREEMENT AND CONSENT FOR ELECTRONIC INFORMATION
Please read this Agreement and Consent for Electronic Information and retain a copy for your future reference. We are providing this Agreement and Consent to you as a user of CompassPC banking services (" CompassPC"). This agreement is in addition to other agreements between us, including your checking, savings, and other deposit account agreements, your CompassPC agreements, your credit card agreements, your loan agreements, agreements for debit card or other electronic access to any loan or deposit account you have with us, and overdraft protection agreements. In this agreement, the words "we", "us," or "our" mean Compass Bank. The words "you" or "your," mean each person or entity that has an interest in an account or other relationship that is accessible through CompassPC and any person authorized to have such access. CompassPC means the information, communications, and transactions provided to you through your use of CompassPC on our web site (the "Site"), and includes, but is not limited to, the following, if available to you: account information, statement viewing and download, funds transfers, bill payments, stop payments, check inquiry and printing, check reorder, loan applications, and advances on lines of credit. By clicking the "Agree" button below, you agree to the terms of this Agreement and Consent for Electronic Information. If you do not give your consent by clicking the “Agree” button below, you will not be permitted to use most features of CompassPC.
AUTHORIZED USERS
Your use of CompassPC may be made by use of certain numbers, codes, marks, signs, public keys, or other means that are acceptable to us. Each such means is referred to in this agreement as a "Password." These are a means of establishing your identity as an Authorized User of CompassPC. If you give someone else your Password then that person is also an Authorized User of your CompassPC. When you use CompassPC or you permit any other person or other entity to use CompassPC by giving them your Password, you agree to the terms and conditions we have established for use of CompassPC and any instructional material that we provide to you regarding CompassPC.
CONSENT TO ELECTRONIC INFORMATION
All electronic information available to or accessed by an Authorized User of your CompassPC or sent to the e-mail address you have given us will be given the same legal effect as paper information given to you. Any acceptance of the terms of electronic information by an Authorized User, when required, will be given the same effect as information on paper that is accepted by you. You agree that copies of electronic information are valid and you will not contest the validity of the originals or copies, absent proof of altered data or tampering.
SCOPE OF CONSENT
Your consent to electronic information applies to the following information:
- Electronic information about Compass accounts set up for access through CompassPC: Any agreement or terms of service related to an account, fees for an account, any notice or information that we are required to give you or make available to you by statute or regulation or under the terms of an agreement with you ("Disclosures"), statements, records, reports, communications about an account, documents, and any changes to the foregoing.
- Electronic information about CompassPC: all notices, agreements, terms of service, Disclosures, reports, documents, communications and other records relating to your use of CompassPC, fees for CompassPC, and any changes to the foregoing.
If any owner of an account consents to electronic information, then any electronic information we give for that account will satisfy any Disclosure requirements for all owners of the account. If we do not make any of the above types of electronic information available to you and are required to provide it by law or regulation, then we will provide you a copy by other means.
RIGHT TO WITHDRAW CONSENT FOR ELECTRONIC INFORMATION
The withdrawal of your consent to receive electronic information will not affect the legal validity or enforceability of prior electronic information already given or made available to you. Your withdrawal will be effective after we have had a reasonable time to process it and reinstate sending you information by other means, if applicable.
- Electronic Information about CompassPC. You must agree to accept electronic communications about CompassPC (as described above) in order to use CompassPC. You can withdraw your consent to receive electronic communications about CompassPC only by closing your CompassPC account. In order to do this, call 1-800-273-1057.
- Electronic information about your accounts. If you ask us to stop sending you paper statements about any account, then you will only get statements, Disclosures, and other information about your account or related to your account by electronic means. If you wish to reinstate receiving paper statements and other information that comes with your statements or is mailed to you with respect to an account, then you can do so through CompassPC. You can also call CompassPC Customer Service at 1-800-273-1057 to reinstate receiving your paper statements.
- Paper copies of certain electronic information. Even if you do not withdraw your consent to receive electronic information, as described above, you may be able to get paper copies of certain electronic information if it is available. Please call the Customer Service number or 1-800-COMPASS to see if a particular paper version of a disclosure, agreement, or other information is available to be mailed to you. To the extent allowed by law, we reserve the right to charge a fee for paper copies of electronic disclosures to which you have consented. Our fees for paper copies may change from time to time. You may obtain information about such fees when you call us to request a paper copy.
DELIVERY OF ELECTRONIC INFORMATION
We will make electronic information available by posting it on the Site or at any other applicable website that you use. Statements for any Compass accounts that are available online can be accessed in hypertext markup language ("html format") in the same way you are viewing this agreement and in Adobe Portable Document Format (" pdf"). Some electronic information will be made available when you use or begin to use an electronic service. We will alert you about the availability of Disclosures, changes in terms, and certain other information made available on the Site by sending an e-mail to one or more of the e-mail addresses you have provided to us.
CHANGE OF E-MAIL ADDRESS OR MAILING ADDRESS
You must advise us of e-mail address changes by logging on to your CompassPC account and changing the information. You may also call CompassPC Customer Service at 1-800-273-1057. We will not re-send an e-mail notice sent before we have had a reasonable time to process a change to your e-mail address. Please allow one business day for us to process changes in e-mail address information.
HARDWARE AND SOFTWARE REQUIREMENTS
In order to access and retain electronic information, you must meet the following hardware and software requirements:
- E-mail address

- Macintosh System 7.5.5 or higher
- 32 MB RAM
- 800x600 or higher video resolution (recommended)
- Internet Access (28.8/56 kbps modem, cable modem, DSL, etc.)
- Internet Explorer 5.x and higher
- Mozilla (all versions, including Netscape 6.x and higher)
- Mozilla Firefox (all versions)
- Safari (Macintosh only)
- AOL versions 3.0 and higher

AGREEMENT TO THESE TERMS
By clicking the “Agree” button, you agree and consent to receive electronic information concerning CompassPC and your accounts, as described above, and agree that this Consent for Electronic Information constitutes a part of your agreements with us for your accounts and for CompassPC. You acknowledge that reading and accepting this agreement demonstrates your ability to access information electronically. You also acknowledge the software and hardware requirements noted above. You confirm and represent that you, in fact, have accessed and are able to view, save, and print any sample electronic records or information made available to you in order to demonstrate the applicable CompassPC or as part of the CompassPC enrollment process. You may click the “Disagree” button if you do not accept the terms of this Consent for Electronic Information, but if you decline, you will not be permitted to use the applicable CompassPC service.
