Agreement and Disclosure Statement for CompassPC® wiith Microsoft® Money, Quicken® or via the Compass Web Site
Welcome to Compass Bank! We are excited to have the opportunity to serve your online banking needs. Please read carefully the Agreement and Disclosure Statement for CompassPC®, including the Service Charge Schedule, and keep it with your records. The terms of this Agreement will become effective on March 15, 2008. Your use of CompassPC following this effective date signifies your acceptance of this Agreement, including the following changes to the terms of your online banking services:
- Agreement and Consent for Electronic Information. Before you may login to CompassPC for the first time, you will be presented with an additional agreement containing the terms under which we may provide information electronically to you about these services and your online banking accounts. If you choose not to accept these terms, you will not be permitted to use CompassPC.
- Security. By choosing to receive CompassPC, you are accepting the security procedures described in Section 6.
- Bank's telephone number and address. Please contact us immediately as provided in Section 8 if you believe any Security Code is subject to unauthorized use or that an unauthorized transaction may be or has been made from any online banking account, or as provided in Section 14 in case of errors or questions about transactions to or from an online banking account.
- Online Banking Accounts. You may use Compass PC to access the kinds of accounts described in Section 3. In order to receive online access to any such account, you must be a signatory on that account.
- Stop payment. Please contact us immediately as provided in Section 4.B.ix if you want to stop a Bill Pay payment that was scheduled through CompassPC Bill Pay.
- Business days. For the purposes of this Agreement, “Business Day” means Monday through Friday, excluding all holidays recognized by the federal government. However, you can access your CompassPC accounts 24 hours a day, as provided in Section 17.
- Online transfers or transactions. Please refer to Section 4 for a description of the transfers and transactions available through Compass PC. In certain circumstances, we may need to limit the amount or frequency of your online transfers.
- Documentation. You will receive periodic statements for your online banking accounts as provided in Section 7. For information about obtaining your banking statements electronically, please refer to Section 4.A.ii.
- Confidentiality. From time to time we need to disclose information to third parties about your online banking accounts and the transfers to and from each account, as provided in Section 13.
- Liability. Please refer to Sections 9 and 11 for a description of your liability for unauthorized transfers from consumer and commercial online banking accounts. Please refer to Sections 10 and 12 for a description of our liability to you.
- Fees. Fees for these online banking services are described in Section 5 and are listed in the Service Charge Schedule. Although there is no charge for CompassPC Banking, with certain deposit accounts you may be required to pay a monthly fee for the Compass PC Bill Pay service.
- Arbitration. By choosing to receive CompassPC, you are accepting the arbitration and waiver of jury trial provisions contained in Section 16.
